The treatment ponds will be used to treat excess mine water
discharge from 6MN reservoir.

Because of existing road, power and other mine infrastructure in the project area, which has
in turn affected the overall suitability of this site for wildlife, CPW does not anticipate this
individual action will affect the distribution and abundance of wildlife species associated with
this project. However, CPW submits the following comments and recommendations:

1. CPW assumes that Twentymile Coal, LLC will follow existing DRMS guidelines regarding
hazardous materials discharge levels, and ensure that there are no hazardous or toxic
substances allowed to enter Fish Creek.

2. CPW recommends Twentymile Coal, LLC ensure that the treatment ponds do not trap
wildlife and prohibit wildlife from exiting each pond.

3. CPW recommends Twentymile Coal, LLC preclude use by livestock in all wetland areas
that are created as a result of this project.

CPW appreciates the opportunity to provide comments for the Foidel Creek Mine 6MN Passive
Water Treatment System. For additional information or to request clarification on CPW’s
comments, please contact Brett Smithers, Land Use Specialist, at 970-878-6069.
