WASTEMINE., IC,
P.O. Box 3471 Rapid City, SD 57709-3471 (605)348-0244 M E N
PO Box 88 Cortez, CO 81321-0088 (970) 564-1380
E-mail: WASTELINE&;-aol.com
05 August 2016
Lucas West, Environmental Protection Specialist
Division of Reclamation Mining and Safety
1313 Sherman Street, Room 215
Denver, CO 80203
SUBJECT: Technical Revision # 1, M1985-001 J&J Pit, La Plata County
Dear Mr. West:
The enclosed request for a technical revision to the existing permit is submitted, as
discussed on 2 June 2016, to the Division. It is planned to submit the supporting
documents (referenced below) by 01 SEP 2016, which was (to my understanding) the
date for which the technical revision would be submitted and NOT the date by which
the Division would make a decision regarding that technical revision. Since there is no
way in which either you or I can control the time necessary for the division to review the
technical revision request. I believe that it is inappropriate to establish a decision date
without providing adequate opportunity for proper review, discussion, and providing
necessary additional information. This letter also responds to your letter of 22 JUL 2016.
The purpose of this request for technical revision is:
a) To clarify information provided in the original application, which does not meet
current standards for accuracy, detail, and which has created significant
confusion on all parts in the past.
b) To revise/replace the existing Mining Plan (Exhibit C) including addressing other
concurrent use (storage/processing of materials).
c) To revise/replace the existing Reclamation Plan (Exhibit D), including a
revised/reploce attachment to Exhibit D detail the seed mix and other matters of
revegetation, and clarifying post -reclamation use.
d) To revise/replace/supplement the existing Maps (Exhibit E)
e) To revise/supplement the existing Permanent Structures Plan (Exhibit L)
f) To provide a Geotechnical Stability Exhibit (Section 6.5) to support Exhibits C, D,
and L
g) To provide a mutually agreeable basis on which to calculate the financial
warranty necessary for operations for the next four -five years.
realize that other Exhibits may also require revision to match. and that it is unlikely that 1
am able to provide all information to the satisfaction of the Division in the first submittal,
and am prepared to respond to your review as rapidly as possible. Please communicate
with me by both hard copy and by e-mail, so that I may do so in a timely manner.
Respectfully,
Nathan A. Barton, CE, PE, DEE
Environmental and Permitting Compliance Engineer
Enclosures: TR Form, Check ($216.00)
Supporting clients in the Great Plains and Great Basin - Since 1992
