PERMIT#: M-2016-019
INSPECTOR'S INITIALS: MAC
INSPECTION DATE: August 15,2016
OBSERVATIONS
The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety
(Division). Jim Hastings, the property owner, was present for the inspection along with Ben Langenfeld with
Greg Lewicki and Associates. The Beaver Creek site is located on Beaver Creek approximately 1.5 miles
northwest of Fairplay, Colorado.
The Division received notice from the Park County Planning Department on March 22, 2016 of a possible
illegal operation along Beaver Creek. The inspection was delayed until the property owner was present and
the site was accessible. The purpose of the inspection was to determine if the owner of the property was
engaged in illegal mining activities.
Mr. Hastings owns a 40 acre parcel along Beaver Creek. The portion of his property which spans Beaver Creek
contains historic dredge piles. Mr. Hastings has been in the process of flattening out the dredge piles to create
a level and usable area. Mr. Hastings informed the Division that his goal is to further reclaim the leveled area
by importing topsoil and establishing vegetation. In addition, Mr. Hastings is clearing an area for a future
home site. The home site is located approximately 0.25 miles west of Beaver Creek. Mr. Hastings has
constructed a road which leads to the home site. According to Mr. Hastings, the road was constructed under a
permit issued by Park County. The material for the road construction was stockpiled on the level area adjacent
to Beaver Creek and a grizzly screen was located next to the stockpile. Mr. Hastings has also stockpiled timber
on the level area which was felled from his home site.
The Division did not observe any signs of mining on Mr. Hastings property. There were no cuts, pits or other
disturbances which indicated that mining was occurring. The disturbances which were observed were
consistent with the description of the land improvement activities Mr. Hastings informed the Division he was
engaged in. Mr. Hastings informed the Division that he may wish to allow recreational panning and sluicing on
his property in the future. The Division directed him to submit an Is It Mining Questionnaire prior to engaging
in prospecting or mining so that the Division may make a determination as to the type of permit that may be
required for the proposed activity.
This concluded the inspection.
