Also included is a copy of the location map for this amendment. This
information is provided in compliance with the Rules and Regulations for Construction Materials promulgated
by the Colorado Mined Land Reclamation Board in compliance with Colorado law.
This reconsideration is due to an administrative error by Schmidt Construction in not providing the
necessary financial warranty within one year of the approval of the amendment. When this occurs it is
necessary to publish a new notice, post the property, and notify adjacent landowners that a reconsideration is
occurring. The land within the amendment area has not been disturbed by mining. No changes to the plan as
originally approved are proposed in the reconsideration. This notification is provided so the public or adjacent
landowners are given an additional opportunity to comment on the plans. As the public notice states, if you
have comments, for or against, those must be provided to the Division of Reclamation, Mining, and Safety no
later than 4:00 p.m. on September 13, 2016. A copy of the complete application as originally approved is
available at the El Paso County Clerk and Recorder Office.
Respectfully,
Mark A.
