PERMIT#: M-1990-140 <br /> INSPECTOR'S INITIALS: ACY <br /> INSPECTION DATE: July 19,2016 <br /> Some weeds were observed. In talking with the operator they have already sprayed twice this year. It is <br /> recommended that they continue to spray on a monthly basis to effectively treat all emerging weeds. Noxious <br /> weeds observed were Tamarisk, Dalmatian toadflax, white top, several thistle species, knapweed, Russian <br /> thistle, and kochia. The presence of tamarisk is cited as a problem. Currently only a few sprigs have emerged <br /> near the two "ponds". The operator shall remove all tamarisk from the permit boundary and provide the <br /> Division with photo documentation by the corrective action date. <br /> The area proposed for CN-1 consists of mostly cropland. Approximately half of the cropland is fallow while the <br /> other half is planted with winter wheat. It is noted that according to Mr. Duran the farmer is responsible for <br /> weed spraying in the fields. Currently along the southeast portion of the wheat fields there is a large <br /> infestation of knapweed. As well as several other noxious weeds scattered throughout all of the fields.The <br /> operator will need to remain vigilant in weed management with a noxious weed source in such close <br /> proximity. <br /> The rangeland portions in the proposed CN-1 area have a variety of perennial grasses at high density. Some <br /> areas have large amounts of mature sagebrush with low density grass undergrowth. There is a variety of <br /> grasses, forbs and shrubs thriving in these perimeter areas. <br /> The Division currently holds a financial warranty amount of$21,220 for this site. The Division will be updating <br /> the reclamation cost estimate as part of the CN-1 approval processes. The bond will be based off of the <br /> requirements submitted in the CN-1 reclamation plan. <br /> During the conversion application process the operator was made aware that subsurface mineral rights are <br /> owned by the Colorado State Land Board (SLB) not by the operator. Currently the operator is in negotiations <br /> with the (SLB) to work out a lease agreement. Mining in the 112c area will not be permitted until the legal <br /> right to access and land ownership issues are resolved. <br /> No other problems or violations were noted during this inspection. <br /> Responses to this inspection report should be directed to: Amy Yeldell at the Division of Reclamation, Mining <br /> and Safety, 1313 Sherman St., Room 215, Denver, CO 80203.
