Mitchell from the Division of Reclamation, Mining and Safety, along with Jon <br /> Mueller of Elam Construction (Elam). A report dated May 17, 2016 indicates that there is a <br /> possible violation /problem that exists at the Pit for the impoundment of water in the pit. <br /> Three meetings have been held, along with several corresponding emails and phones call <br /> between the landowner, the landowner consultant, Elam, and the hydrologist hired by Elam to <br /> aid in abating this problem. All parties have concluded to reach an understanding by way of <br /> contract. A Memorandum of Understanding between Elam and the landowners will be <br /> executed in a timely manner. Once this agreement is reached Elam will have the sole <br /> responsibilities in obtaining a water right through the Water Court, as well as, a well permit by <br /> demonstrating a plan for augmentation. The hydrologist advised Elam of the timeline <br /> associated with obtaining a plan for augmentation. The timeframe for the finalizing a water <br /> right and well permit including, obligations to purchase water out of the correlated reservoir <br /> suggests that a 12 month extension to abate this noted problem should be sufficient to <br /> complete all necessary items. <br /> If the process is deemed quicker than originally suggested Elam will update and expedite the <br /> abatement process as soon as possible. By all means Elam has every intention for rectifying <br /> this noted problem and will seek to complete this corrective action. The original Corrective <br /> Action Due Date was set for August 16, 2016. Therefore, we propose the 12 month (1 calendar <br /> year) extension date of August 16, 2017 for entirety of the problem to be resolved. <br /> Thank you for your time and consideration in this matter.
