AA RECF.' <br /> VV AUG 13 2016 <br /> DIVISION OF RECLAMATION <br /> M i n e Wa to r MINING AND SAFETY <br /> Mr. Michael Cunningham August 13, 2016 <br /> Division of Reclamation, Mining and Safety --Denver Office <br /> RE: NOTICE OF DEFICIENCIES IN NOI FILE NO.P2016-020 <br /> Dear Mr. Cunningham, <br /> Thank you for your letter of August 12, 2016 which contained a detailed review of the NOI <br /> submitted August 8th and noted deficiencies in the NOI. We appreciate and welcome your <br /> review as this process assists us in achieving a better quality outcome from the work program. <br /> For clarity of our response, I have excerpted each deficiency and provided or referenced our <br /> response as appropriate, within the text, below: <br /> 1. The Applicant has proposed to disturb 0.5 acres for the prospecting operation. The <br /> disturbance associated with the drill pads and mud pits accounts for 0.25 acres. Please <br /> account for the remaining 0.25 acres of disturbance. <br /> Each drill pad is intended to occupy a 50x5O foot area. We were told by the drilling <br /> contractor that we will be able to minimize the disturbance by having the mud pits within the <br /> drill pad area. If for some reason we are not able to locate the mud pits on the drill pads, we <br /> have accounted for mud pits adjacent to the drill pads and for this reason we estimated a total <br /> disturbance of 0.5 acres. <br /> 2. The units were not included for the amount of material proposed to be moved. Please verify <br /> the Operator intends to extract or move 5,700 cubic feet of material. <br /> We intend to extract 5,700 cubic feet(or less) of material. The Form does not allow entry of <br /> units into the box where the quantity is requested, as that section is limited to allow numeric <br /> entry only. <br /> 3. The Applicant has stated the drill holes may be used as monitoring wells. Please note that <br /> prospecting drill holes may be converted to monitoring wells in accordance with the <br /> requirements of Rule 5.4.4. <br /> We acknowledge that conversion of the prospecting drill holes to monitoring wells will only <br /> be done in accordance with Rule 5.4.4. If such conversion is not needed and not completed <br /> during our prospecting activities, then we will proceed with plugging and abandonment of all <br /> holes as required. <br /> 4. The Applicant is proposing to conduct prospecting on areas recently reclaimed by the <br /> Service yard—10924 Leroy Drive, Northglenn CO 80233 <br /> PO Box 3729, Englewood CO 80155 <br />
