This is a civil action commenced under section 309(b) and (d) of the Clean Water <br />Act (“CWA” or “Act”), to obtain injunctive relief and civil penalties against Varca Ventures, <br />Inc. (“Varca”) and Wildcat Mining Corporation (“Wildcat”) (collectively, “Defendants”), for <br />discharging pollutants into waters of the United States in La Plata County, Colorado, <br />without authorization by the United States Department of the Army, in violation of CWA <br />section 301(a), 33 U.S.C. § 1311(a), and for violation of a compliance order issued by the <br />United States Environmental Protection Agency (“EPA”) to Defendants pursuant to CWA <br />section 309(a)(3), 33 U.S.C. § 1319(a)(3). <br />Case 1:16-cv-02008-WYD Document 1 Filed 08/08/16 USDC Colorado Page 1 of 10
