UNITED COMPANIES <br />RE: Colona Gravel Pit, M-1994-005, Citizen Complaint <br />Mr. Czapla, <br />We are in receipt of your Citizen Complaint Letter dated July 27, 2016 <br />To be honest I'm very confused about this letter from the new owners of the Jutten property. I just wanted to let you <br />know that we have been working diligently with them to get a plan to reclaim their portion of the Colona Pit. I would <br />like to give you a little bit of background history of what we have been doing. <br />Back in 2014 we tried to purchase the property from Jutten when he had it up for sale. Jutten was not very excited <br />about selling the property to Oldcastle because he tried to sell it to us in 2013 and we told him we were not <br />interested. I believe he was upset about that. Subsequently he sold the property to Walchle. <br />I believe sometime in 2014 or 2015, prior to Walchle purchasing the property, Walchle approached us about the <br />feasibility of creating the property into a wetlands. He wanted to bring in another operator to work the pit, sell the <br />gravel and create several shallow ponds over the area. We told him we wouldn't allow another operator to come into <br />the permitted area, give him access to the highway and compete with us. Walhcle was not happy about this. I'm sure <br />you can see the logic in our decision. We spend tens of thousands of dollars to open a pit, build acel/decal lanes, <br />permitting costs, etc. We don't do this to have a competitor just walk in and start competing with us at no cost to <br />them. <br />Since Walchle purchased the property in 2015 we have been working with them on a plan to reclaim their site. Right <br />after Walchle purchased the property they approached us with a proposal to either buy our property or we should <br />purchase their property, We are not interested in selling our property and we could not come to terms with them to <br />purchase their property. Walchle was not happy about this. <br />Our original proposal to them for reclamation was to bring in 3' of material from another site to fill the site <br />adequately above the ground water and seed the site per the DRMS plan. In April Walchle proposed to us another <br />option which is represented in the recently submitted TR for Colona. They want to have a 3 acre pond constructed in <br />the pit.
