GRAVEL PURCHASE AGREEMENT <br /> Owner of Gravel Purchaser of Gravel and <br /> Permit Operator <br /> Mary Belle Rafert Phillips County <br /> 28416 Co Rd 53 221 S Interocean Ave <br /> Amherst,CO 80721 Holyoke,CO 80734 <br /> Mary Belle Rafert,owner of the gravel in the Rafert gravel pit located in the SE%of Section 33, <br /> T8N,R43W of the 6th P.M.,Phillips County,Colorado hereby agrees to sell gravel to Phillips County. <br /> Phillips County, as the purchaser, hereby agrees to obtain a mining permit from the State of <br /> Colorado and act as the operator of the pit. The plan for reclamation of the pit is hereby approved <br /> by the owner as this agreement is ratified. <br /> Gravel will only be taken from the areas described in the permit unless both the owner and Phillips <br /> County agree to extend the area to be mined. <br /> Research indicates that surface ownership of this land is held by Mary Belle Rafert Revocable Trust <br /> and that the mineral rights are owned by Mary Belle Rafert Revocable Trust <br /> Mary Belle Rafert hereby certifies that payment should be made to her at the aforementioned <br /> address. <br /> Claims for payment for gravel made by any other parties concerning this pit shall not be the <br /> responsibility of Phillips County. <br /> Phillips County agrees to pay 45t a yard for the gravel. Payment will be made to Mary Belle Rafert <br /> at the above address. This agreement is made for a period of five 5 years and may be extended <br /> by mutual agreement or terminated with 60 days' notice.
