-'��,.�86�.��� <br /> Weld County,Colorado <br /> PROJECT No.B 1400202 <br /> o u Nw N Book 1 -Contract <br /> 6.2.5.2 Minimizing the County's Reimbursement Obligation <br /> In designing and constructing the Project, the Contractor shall take all reasonable steps to <br /> minimize costs to the Utility Owners under the Utility Relocation Agreements, to the extent <br /> practicable and otherwise consistent with other requirements of the Contract Documents. <br /> 6.2.6 Additional Restrictions on Change Orders <br /> In addition to all of the other requirements and limitations contained in Section 13 and the <br /> Addendums, the entitlement of the Contractor to any Change Order under this Section 6.2 shall <br /> be subject to the restrictions and limitations set forth in this Section 6.2. <br /> 6.2.6.1 Burden of Proof <br /> For Relocations, the Contractor shall bear the burden of proving that the Relocation cannot <br /> reasonably be avoided. <br /> 6.2.6.2 Coordination Costs <br /> The Contractor shall not be entitled to an increase in the Contract Price for any costs of <br /> coordinating with Utility Owners or for assisting the County in coordinating with Utility Owners. <br /> 6.2.6.3 Voluntary Action by Contractor <br /> If the Contractor elects to make payments to Utility Owners or to undertake any other efforts <br /> which are not required by the terms of the Contract Documents, the Contractor shall not be <br /> entitled to a Change Order in connection therewith. The Contractor shall promptly notify the <br /> County of the terms of any such arrangements. <br /> 6.3 Environmental Compliance <br /> In performance of the Work, the Contractor shall comply with all requirements of all applicable <br /> Environmental Laws and Governmental Approvals issued there under,whether obtained by the <br /> County or the Contractor. The Contractor acknowledges and agrees that it will be responsible <br /> for all fines and penalties that may be assessed in connection with any failure to comply with <br /> such requirements. <br /> 6.3.1 Mitigation Requirements <br /> The Contractor shall perform all environmental mitigation measures (which term shall be <br /> deemed to include all requirements of the Environmental Approvals and similar Governmental <br /> Approvals, regardless of whether such requirements would be considered to fall within a strict <br /> definition of the term) for the Project except the environmental mitigation measures the County <br /> has agreed to perform or provide. The Contract Price includes compensation for the Contractor's <br /> performance of all such mitigation measures and for performance of all mitigation measures <br /> arising from New Environmental Approvals which Section 6.3 designates as the Contractor's <br /> responsibility as well as the cost of all Activities to be performed by the Contractor as described <br /> in Book 2, Section 5. <br /> 35 <br />
