1861. <br /> Weld County,Colorado <br /> PROJECT No.B 1400202 <br /> pou N 1 V_ Book 1 - Contract <br /> Section 6.2 or in circumstances for which such a Change Order is otherwise permitted under <br /> Section 13 (such as for County-Directed Changes which increase the Utility Work to be <br /> furnished or performed by the Contractor). A deductive Change Order for reductions in the <br /> Utility Work to be furnished or performed by the Contractor shall be issued only in <br /> circumstances for which a deductive Change Order is otherwise permitted under Section 13. <br /> Notwithstanding the foregoing, the Contractor's entitlement to any Change Orders pursuant to <br /> Section 13 relating to the Utility Work shall be subject to any applicable limitations and <br /> restrictions set forth in this Section 6.2, and the Contractor's entitlement to any Change Orders <br /> pursuant to this Section 6.2 shall be subject to the limitations, restrictions and procedures set <br /> forth in Section 13. <br /> 6.2.2 Reserved <br /> 6.2.3 Betterments and Requested Relocations <br /> Utility Betterments and Requested Relocations may be added to the Work pursuant to this <br /> Section 6.2.3 and Book 2, Section 7. <br /> 6.2.3.1 Procedure <br /> Any Utility Owners may request the County to permit the Contractor to perform work relating to <br /> Betterments or Requested Relocations as a part of the Work, at the Utility Owner's expense. If <br /> the County Approves any such request, the Contractor will have the obligation to perform such <br /> work, with the right to receive additional payment and, if applicable, an extension of the <br /> Completion Deadline as provided in Section 6.2.4.2. The price charged by the Contractor for <br /> such Betterment or Requested Relocation shall be either a lump sum amount negotiated with the <br /> Utility Owner or determined on a time and materials cost basis as specified below. Any <br /> extension of the Completion Deadline or Contract Price increase requested for any Betterment or <br /> Requested Relocation shall be subject to the requirements of Sections 6 and 13, as applicable. <br /> The County will Approve the addition of a Betterment or Requested Relocation to the scope of <br /> the Work under this Section 6 only if. (i) the Utility Owner has agreed to the addition of such <br /> Betterment or Requested Relocation to the Work; (ii) such Betterment is compatible with the <br /> Project; (iii) the Utility Owner has agreed to reimburse the Contractor for all the costs thereof, <br /> (iv) the Utility Owner has agreed as to the method(negotiated lump sum amount, or time and <br /> materials cost basis) of pricing such Work; and(v) it is feasible to separate the cost/pricing of the <br /> Betterment or Requested Relocation work from that for any related Utility Work being furnished <br /> or performed by the Contractor. The Contractor shall provide the County with such information, <br /> analyses and certificates as may be requested by the County in connection with its Approval. <br /> Any change in the scope of the Work pursuant to this Section 6.2.3 shall not be considered a <br /> County-Directed Change. <br /> 33 <br />
