Weld County, Colorado <br /> PROJECT No.B 1400202 <br /> _o u N t aC, Book 1 - Contract <br /> 2.3.5 Governmental Approvals <br /> The Contractor has no reason to believe that any Governmental Approval required to be obtained <br /> by the Contractor will not be granted in due course and thereafter remain in effect so as to enable <br /> the Work to proceed in accordance with the Contract Documents. If any Governmental <br /> Approvals required to be obtained by the Contractor must formally be issued in the name of the <br /> County, the Contractor shall undertake all efforts to obtain such approvals, subject to the <br /> County's reasonable and timely cooperation with the Contractor, including execution and <br /> delivery of appropriate applications and other documentation in forms Approved by the County. <br /> The Contractor shall assist the County in obtaining any Governmental Approvals which the <br /> County may be obligated to obtain, including providing information requested by the County and <br /> participating in meetings regarding such approvals. <br /> 2.3.6 Progression of Work <br /> The Contractor shall at all times schedule and direct its Work to provide an orderly progression <br /> of the Work to achieve Completions and Final Acceptance by the applicable Completion <br /> Deadlines and in accordance with the Contract Schedule, including furnishing such employees, <br /> materials, facilities and equipment and working such hours (including extra shifts, overtime <br /> operations,non-Working Days) as may be necessary to achieve such goals, all at the <br /> Contractor's own expense, except as otherwise specifically provided in Section 13. <br /> 2.3.7 Employee Performance Requirements <br /> All employees shall have the skill and experience and any licenses or certifications required to <br /> perform the Work assigned to them. If the County determines in its sole discretion that any <br /> Person employed by the Contractor or by any Subcontractor is not performing the Work properly <br /> and skillfully, then, at the written request of the County, the Contractor or such Subcontractor <br /> shall remove such Person and such Person shall not be re-employed on the Project without the <br /> prior written approval of the County. If the Contractor or the Subcontractor fails to remove such <br /> Person(s) or fails to furnish skilled and experienced personnel for the proper performance of the <br /> Work, then the County may, in its sole discretion, suspend the affected portion of the Work by <br /> delivery of written notice of such suspension to the Contractor. Such suspension shall in no way <br /> relieve the Contractor of any obligation contained in the Contract Documents or entitle the <br /> Contractor to a Change Order. <br /> 2.3.8 Design and Engineering Personnel <br /> All design and engineering Work furnished by the Contractor shall be performed by or under the <br /> supervision of Persons licensed to practice architecture, engineering or surveying (as applicable) <br /> in the State, and by personnel who are careful, skilled, experienced and competent in their <br /> respective trades or professions, who are professionally qualified to perform the Work in <br /> accordance with the Contract Documents, and who shall assume professional responsibility for <br /> the accuracy and completeness of the Design Documents, Released for Construction Documents, <br /> Field Design Change Documents and As-Built Documents prepared or checked by them. <br /> 19 <br />
