<br /> <br /> <br /> <br />PR-04, Colowyo Coal Mine C1981-019 45 August 2016 <br /> <br />STIPULATION 7 <br /> <br /> THE COLOWYO COAL COMPANY SHALL SUBMIT A TECHNICAL REVISION TO THE <br />DIVISION WHICH PROVIDES AN ANALYSIS OF GROUNDWATER POINTS OF <br />COMPLIANCE AT THE COLOWYO MINE PURSUANT TO RULE 4.05.13(1). THIS <br />ANALYSIS WILL BE DONE IN CONSULTATION WITH THE DIVISION AND WILL <br />INCLUDE A WRITTEN DETERMINATION OF THE NEED FOR GROUNDWATER <br />POINTS OF COMPLIANCE AT THE MINE. IF DEEMED APPROPRIATE, BASED ON <br />THIS ANALYSIS, COLOWYO SHALL ESTABLISH ONE OR MORE POINTS OF <br />COMPLIANCE FOR THE COLOWYO MINE. <br /> <br /> <br /> <br />IV. Topsoil - Rules 2.04.9, 2.05.3(5), 2.05.4(2)(d) and 4.06 <br /> <br />The Permit has been found to be in compliance with Rules 2.04.9, 2.05.3(5), 2.05.4(2)(d) and <br />4.06 with regard to the protection of topsoil resources. The Division has approved alternative <br />procedures for topsoil protection following removal based on a demonstration that such <br />alternative procedures will provide more protection for the topsoil [Rule 4.06.1(2)]. <br /> <br />A. The Soil Resource <br /> <br />The Collom permit expansion area contains deep soils in mostly moderately sloping locations on <br />the benches and drainages, shallow soils on the steep slopes at the north end of the proposed <br />disturbance area, and very deep soils on the steep slopes at the southern end of the proposed <br />disturbance area. The primary limitation of the soils is a high percentage of clay, with a high <br />percentage of coarse fragments and occasional shallow depth to bedrock restricting potential <br />salvage depth. Soils in the north end of Collom permit expansion area tend to be frigid and <br />aridic, while soils identified in the southern end of the expansion area are cryic and ustic. <br /> <br />Salvageable thickness of soils in the northern portion of the Collom permit expansion area can <br />average two feet or more. <br /> <br />B. Topsoil Salvage Operations <br /> <br />Information on topsoil salvage methods is found in sections 2.04, 2.05, and 4.06 of the PAP <br />original volumes. Additional information can be found in Exhibit 9 and Maps 5 and 6 of the PAP <br />original volumes. Information specifically pertinent to proposed Collom expansion topsoil <br />salvage operations is presented in Rule 2.05.3 of Volume 15, as well as Section 4.06 of Volume <br />15, Exhibit 9 of Volume 19, and Maps 5D and 28C of Volume 22.
