Burbridge <br />Box 92 <br />Nucla CO 81424 <br />August 3, 2016 <br />Colorado Division of Reclamation Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street <br />Room 215 <br />Denver, CO 80203 <br />RE: Phase 3 Bond Release Burbridge's Property <br />To whom it may concern, <br />Prior to this letter of objection, on July 19, 2016 Elmer W. Burbridge met with Mr. Stan Garvey <br />(President of Colorado Cooperative Ditch Company) and witness Mr. Mike Morgan at the <br />divider box at the end of the CC ditch. As a result of that meeting it was verified that the <br />current six (6) inch pipe line will not be large enough to hold the Fifty -Five (55) shares of <br />Burbidge's water to provide adequate flow of irrigation water to Burbridge's property. <br />Especially with other outlets leading off it before getting to the Burbridges. <br />The purpose of this letter is to object to the Phase III Bond release on the Burbridge's land. <br />The reasons for this rejection are as follows: <br />1. Irrigation: <br />a. The irrigation water pipe is not in the easement right way. <br />Explanation: If water is not put on legal easement after bond is released from Elk <br />Ridge Mining (Western Fuels), the water line will be on other land owner/s property. <br />This can cause problems between land owner/s and could led it to Law Suits. In <br />other words to prevent conflicts between all land owners. <br />b. Irrigation pipe is not the correct size to deliver the total Fifty-five (55) shares to <br />the Burbridge's. <br />Explanation: The current six (6) inch pipe line is not large enough to handle every <br />land owner's water. With the six (6) inch pipe line Burbridge will get half of their <br />shares of water. Along with all the outlets going to other property from the same <br />line Burbridge will not get any water if all land owners are using the water at once. <br />Causing hardship and conflict during irrigation for land owner/s. Prevention of <br />conflict before they happen. <br />
