FCM are <br /> excellent tenants and we have had a pleasant business relationship. FCM has expressed the desire to continue to <br /> operate their business on the property and I am happy to continue to have them.We are currently in the process of <br /> renewing the lease. <br /> The presence of the bond with the Colorado Division of Mining was somewhat of a safeguard for me, as land owner,that <br /> when FCM ceased operations at Triangle One Pit,they would be bound by the state of Colorado to complete <br /> reclamation of the site as a tree farm and restore the vegetation to a natural condition. FCM have not actually mined the <br /> property for several years, but the presence of their operation will prohibit them from completing the reclamation <br /> process on the mine floor.They do keep the area neat and clean at all times and I am very pleased with their <br /> environmental ethic. <br /> I have discussed this issue with FCM representatives and feel positive that we will come to an agreement on a final <br /> reclamation plan in our contract.We will need a few months, however to complete that process. <br /> We are in an unusual, but workable situation. <br /> I respectfully request that the release of the FCM,Triangle One Pit bond with the Colorado Division of Mining be <br /> postponed until we have completed our discussions and settled on terms.This should occur well before the end of 2016. <br /> Again, please know that I have a high level of confidence in,and respect for Four Corners Materials.They have been <br /> responsible,trustworthy,conduct their business in an efficient,conscientious manner,and are good citizens in the <br /> community. <br /> FCM and I will come to amicable terms soon and,at that time, I will be in favor of the release of their bond. <br /> Thank you for your consideration. <br /> Cathy Bankston <br />
