The final paragraph of the agreement form sent to you includes the following language: <br /> <br />This signature on this Agreement must be notarized, and if the signature is that of a company, <br />corporation, partnership, or governmental agency representative, must be accompanied by a <br />notarized affidavit of signing authority of the individual for that entity. <br /> <br />We have since revised the language of the Opt-In agreement for clarification: <br /> <br />This signature on this Agreement must be notarized, and if the signature is that of a <br />company, corporation, partnership, or governmental agency representative, must be <br />accompanied by: <br /> <br />a) the attached notarized affidavit of signing authority of the individual for that entity, or <br /> <br />b) a resolution of the decision-making body of your company that authorizes an individual <br />to sign the ePermitting Agreement on the company’s behalf. <br /> <br />Our records indicate that XTO Energy Inc is a company (not an individual). Accordingly, the Division will <br />require the inclusion of notarized affidavit of signing authority or corporate resolution along with the <br />signed Agreement. Please provide an affidavit of signing authority or resolution for yourself on behalf <br />of XTO Energy Inc. <br /> <br />I have enclosed blank Agreement and Affidavit of Signing Authority forms for your use.
