New Horizon Mine <br />III. Summary of Reclamation and Management <br />A. General Description <br />The majority of the areas being applied for Phase III bond released were reclaimed in 1994 <br />through 2002. Several areas were reclaimed in 2015 that are remaining as a permanent feature in <br />the post -mine surface. Please see Map 1 for the location of the Phase III bond release areas. <br />The reclamation work that has occurred on all reclamation parcels included backfilling and <br />regrading to the approved post -mining topography, topsoil replacement, seeding with the <br />approved seed mix, and managing each reclamation unit to the post -mine land use for a <br />minimum of 10 years for the initial seeding. Backfilling and grading was conducted as <br />contemporaneously as possible, and topsoil replacement quickly followed backfilling and <br />grading. Seeding generally occurred in the fall and spring. <br />As noted above, all of the reclamation parcels were reclaimed in 1994 through 2002 have met the <br />minimum ten year liability period in accordance with Rule 3.02.3(2)(b). As stated in Rule <br />1.04(7 1), "All of the land uses defined below may include land used for support facilities which <br />are adjacent to, or are an integral part of the land use." The areas reclaimed in 2016 will remain <br />as permanent features (are located adjacent to) and will support the post -mining land use as part <br />of the larger reclamation parcels. Please see Map 2 for the year that initial seeding or permanent <br />seeding took place. <br />In accordance with the criteria set forth in the "Guideline Regarding Selected Coal Mine Bond <br />Release Issues ", issued April 18, 1995, no rill and gully repair has occurred on any of the areas <br />applied for under this application in the last five years, and normal husbandry practices have <br />occurred on all irrigated pasture areas be applied for under this application. <br />Phase I and II bond release has been achieved on all parcels being applied for under this <br />application. Phase I applications were approved in 1995, 1997, 1999, 2002, and 2008 <br />respectively. Phase II bond release was approved for all areas in 2008. <br />The Phase III areas applied for under this application span several different landowner property <br />boundaries. All property boundaries are based off of public records and the Montrose County <br />website. <br />B. Revegetation Success Demonstration <br />The areas included in this Phase III Bond Release Application have been shown to meet the <br />Phase III criteria as set forth by the "Guideline Regarding Selected Coal Mine Bond Release <br />Issues ", issued April 18, 1995 and Colowyo's current permit, Permit C-1981-019, Section <br />2.05.4(2)(e).
