Box 1120 <br />Glenwood Springs, CO 81602 <br />RE: New Horizon Mine <br />Permit No. C-19814108 <br />Notice of Intent to Seek Phase M Bond Release <br />To Whom It May Concern, <br />Tri-State Generation and Transmission Association, Inc. (Tri-State), is the parent company to Elk <br />Ridge Mining and Reclamation, LLC, New Horizon Mine (New Horizon). Therefore, Tri-State on behalf <br />of the New Horizon Mine is notifying you that New Horizon is submitting an application for Phase III <br />performance bond release on approximately 246.7 acres of irrigated pasture, dryland pasture and adjacent <br />support facilities. This application for Phase III release, when submitted, will be denoted as SL -19. A <br />Phase III bond release evaluation demonstrates achievement of Phase 1 and Phase H bond release, a <br />minimum of 5 years since the last seeding and rill and gully repair, and the reclamation parcels have met <br />the requirements of the revegetation success criteria for two years. <br />This written notice is sent to you pursuant to Colorado Division of Reclamation, Mining and <br />Safety (CDRMS) Rule 3.03.2(1). Prior to filing a request for the bond release, New Horizon must send <br />written notices of intention to seek bond release.
