The
stipulation required Twentymile Coal, LLC. to submit revised maps 23c, the Mine Plan Surface
Disturbance & Monitoring Map and Map 29, the Reclamation Map to depict the updated surface
disturbance boundary to account for the additional disturbance that occurred at the Fish Creek Borehole
as a result of a pump failure. These maps were to be submitted within 15 days of completing the site
cleanup and reclamation of the disturbance related to Notice of Violation No. CV -2016-001.
The Division received Map 23c on July 12, 2016 and Map 29 on July 25, 2016. The maps were not
submitted in the required timeframe as it appears the site cleanup was completed on June 22, 2016.
However, the maps that were submitted were reviewed and deemed adequate. The Stipulation is
considered complied with at this time.
If you have any questions feel free to contact me at (303) 866-3567, extension 8120.
Sincerely,
Jared Ebert
Environmental Protection Specialist
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us
John W.
