Box 33695 <br />Denver, Colorado 80233-0695 <br />RE: New Horizon Mine; C-1981-008, Succession of Operators Application, SO2 <br />Dear Mr. Gilbreath: <br />The Colorado Division of Reclamation, Mining, and Safety (Division) has reviewed the above referenced <br />Succession of Operators application that was submitted on behalf of Elk Ridge Mining and Reclamation, <br />LLC. Please note that the revision number has been designated as SO2, as there has already been one <br />succession of operators application approved for this site in 1992. In order for the Division to conduct a <br />complete review of the Succession of Operators application, the following items must be submitted before <br />the application can be deemed complete: <br />1.) The application submitted with the proposed permit transfer is the incorrect form. The correct <br />application for a Request for Transfer of Coal Permit and Succession of Operators is on the <br />Division's website hiw://mining.state.co.us/SiteCollectionDocuments/succession.pdf. Please fill <br />out the application in full and submit it to the Division in accordance with Rule 2.08.6(2)(b). <br />2.) The requirements of the public notice for the SO2 application is discussed in section 2.08.6(3) of <br />the rules and regulations. Please revise the proposed public notice to indicate the address of the <br />original permittee. If this address is the same as the proposed successor permittee address, you <br />may simply indicate that on the proposed public notice. <br />3.) The cover letter with the application indicates that Tri-State will update the Self Bond SB -003 <br />during the next bond renewal process. In order for the Division to approve the Succession of <br />Operators application, the Self Bond will need to be updated now for the new permittee in <br />accordance with Rule 2.08.6(2). Please submit a new bond document and indemnity agreement. <br />The Self Bond document can be found on the Division's website, <br />http://mining.state.co.us/SiteCollectionDocuments/sfbondagreement.pdf. The indemnity <br />agreement is not on the Division's website.
