Current, Previous, and Pending Coal Mining Permits Held by Seneca Property, LLC and
<br />Peabody Investments Corporation
<br />Seneca Property, LLC currently holds two coal mining permits in the United States. Two of
<br />these permits, C-80-005 for Seneca II Mine and C-82-057 for Seneca II -W Mine, were
<br />transferred from Peabody Coal Company to Seneca Property, LLC on October 17, 1994. The
<br />third permit, C-94-082 for Yoast Mine, was issued to Seneca Coal Company, LLC on August 7,
<br />1995. The Seneca II Permit has since been terminated and both the 1I -W and Yoast Permits are
<br />to be transferred to Seneca Property, LLC. Current, previous, and pending mining permits
<br />obtained by Seneca Property, LLC and its principal shareholders are listed in Appendix 3-5.
<br />Legal Owners of Record of the Surface. Coal, Oil, Gas, and Other Minerals. The following lists the
<br />owners of record of the surface, coal, oil, and gas, and other minerals within the permit area of the
<br />Yoast Mine. Exhibits 3-1, 3-2 and 3-3 depict the areas associated with these ownerships. Appendix 3-
<br />2 provides an alphabetical listing of the owners and their addresses. Appendix 3-3 lists the ownership
<br />by legal description as recorded at the Routt County Courthouse.
