Peabod
1111 ENERGY
Seneca Property, LLC
Mrs. Janet Binns
Colorado Division of Reclamation,
Mining, and Safety
1313 Sherman Street — Room 215
Denver, Colorado 80203
303.866.3567 X8107
29515 Routt County Road 27
Oak Creek, CO 80467
970.879.3800
July 5, 2016
Re: Yoast Permit Renewal RN04 — Request for Extension/Hayden Gulch — Change to Active Reclamation
Status
Janet:
With our current focus on immediate permit needs and facilitating bond release, we are working the permit
renewal/mid-term responses in as we can. Since Yoast is in inactive status, we are addressing the pending
permit renewal as a lower priority, and ask that the decision date for the renewal be extended to August 8, 2016.
I also wanted to let you know that we anticipate initiating work this week at the Hayden Gulch Loadout to
remove the rail, ties, and ballast material, as part of our reclamation/bond-release focus. The rail and ties will be
removed from the property for salvage by the contractor, and the ballast material will be loaded and hauled to
the Foidel Creek Mine for use in subsidence mitigation for the Energy Spur rail -line. I have contacted both
Union Pacific and CDOT and we will be coordinating with them on activities within the UP right-of-way for the
Craig branch -line and for removal of the rail -crossing of US40 on the eastern edge of Hayden (requires CDOT
ROW Permit). With initiation of this work, the Hayden Gulch Permit status will change from temporary
cessation to active reclamation, and we will be initiating any appropriate modifications to the monitoring and
inspection schedules.
We appreciate your consideration and continuing patience as we address the many items associated with
Peabody's Colorado properties —
Best regards,
Jerry .
