Box 1470 <br />Rifle, CO 81650 <br />Dear Mr. Saubestre <br />JUL 13 2016 <br />GRAND jutquiuti <br />iE u OFFICE <br />DIVISRECLAMATION MINING & SAFETY <br />Our staff has reviewed American Shale Oil, LLC's (AMSO) Julyl0, 2016 request to amend the <br />approved Plan of Development (POD) by eliminating the requirement of three years of post - <br />operational water monitoring. AMSO made three attempts during 2012 (4 days) and 2013 (15 <br />days) with electric heaters to start the pilot experiment and operate as per their approved POD. All <br />of the heaters failed during start-up and prior to retorting and pyrolyzing the targeted oil shale. <br />No further attempts were conducted In April 2016, AMSO made the decision to cease firture project <br />operations, and to commence immediate site decommissioning and surface reclamation. <br />Temperatures around the production wells never reached temperatures that might have any adverse <br />impact on the underground sources of drinking water (USDWs). In addition, the historical water data <br />analysis submitted indicates that there is no evidence that the identified USDWs in the UIC Permit <br />Statement of Basis were impacted by these startup attempts. <br />Since AMSO heating attempts never reached the operational status of the POD, no pyrolyzation <br />occurred, and there is no evidence of water quality impacts, the requested amendment to the POD is <br />approved. <br />Authorization from Colorado Division of Reclamation Mining and Safety and the EPA may also <br />be required. <br />If you have any questions, please call Paul Daggett, our Mining Engineer, at 970-878-3819. <br />Sincerely, <br />OLauren Brown <br />Assistant Field Manager <br />
