EXHIBIT B <br />SUMMARY OF LITTLE TURKEY CREEK ROAD ROWS <br />ROW A: Grant of right-of-way over and across the existing roadway that had been in place for 20 years as of <br />1957, and that generally follows Little Turkey Creek, for purposes of ingress and egress to and from <br />"Lots 11, 12, 18 and 19" of Section 7 (T16S, R67W of 6`h P.M.), which were owned at the time by <br />Mr. Guy Parker. Although the precise location of these benefitted lots is not clear from the granting <br />document, Section 7 includes real property within the Eagles Nest subdivision (as defined in <br />Exhibit A , and would require use of the same portion of Little Turkey Creek Road for access as <br />does Eagles Nest subdivision. However, as "Lots 11, 12, 18 and 19" do not appear on the El Paso <br />County Assessor's online records, nor does there appear to be any property owned by Mr. Guy <br />Parker within Section 7, we cannot confirm whether this benefitted property was also subject to the <br />decree set forth in ROW B. It appears that the right-of-way granted by this document is consistent <br />with the course of Little Turkey Creek Road. <br />ROW B: Decree granting a right-of-way for "ingress and egress" over and across Little Turkey Creek Road, <br />as legally described therein with a width of 20 feet, to the owners of a portion of the real property <br />within the Eagles Nest subdivision. The decree expressly reserves to the owners of Hitch Rack <br />Ranch the following rights: (a) to erect and maintain three gates at locations specified therein, which <br />gates may be locked with permission from the benefitted property owners; (b) to use Little Turkey <br />Creek Road; (c) to erect cattle guards so long as such cattle guards do not obstruct passage or travel <br />on Little Turkey Creek Road; and (d) to post a sign, not obstructing travel thereon, notifying the <br />public of the private nature of Little Turkey Creek Road. This decree is the grant of right-of-way <br />upon which the Objection Letter bases its claim. <br />ROW C: Agreement between owners of Hitch Rack Ranch and owners of a portion of the real property <br />located within Bauers Ranch (as defined in Exhibit A), granting a right-of-way over and across <br />Little Turkey Creek Road, as legally described in ROW B, for ingress and egress to and from <br />Bauers Ranch. The Agreement expressly reserves to the owners of Hitch Rack Ranch the following <br />rights: (a) to erect cattle guards so long as such cattle guards do not obstruct passage or travel on <br />Little Turkey Creek Road; and (b) to change the location of Little Turkey Creek Road from time to <br />time so long as such relocation does not adversely affect any users of Little Turkey Creek Road. <br />ROW D: Agreement between owners of Hitch Rack Ranch and owners of a portion of the real property <br />located within Bauers Ranch, granting a right-of-way over and across Little Turkey Creek Road, as <br />legally described in ROW B, for ingress and egress to and from Bauers Ranch. The Agreement <br />expressly reserves to the owners of Hitch Rack Ranch the following rights, as pertinent to this <br />memorandum: (a) to erect and maintain gates along Little Turkey Creek Road, which gates may be <br />locked with permission from the benefitted property owners; (b) to erect cattle guards so long as <br />such cattle guards do not obstruct passage or travel on Little Turkey Creek Road; (c) to post a sign, <br />not obstructing travel thereon, notifying the public of the private nature of Little Turkey Creek <br />Road; and (d) to change the location of Little Turkey Creek Road from time to time so long as such <br />relocation does not adversely affect any users of Little Turkey Creek Road. This Agreement also <br />provides that any party thereto may remove itself from the terms of the Agreement by recording a <br />declaration to that effect in the form attached thereto. <br />ROW E: Agreement between owners of Hitch Rack Ranch and owners of a portion of the real property <br />located within Bauers Ranch, granting a right-of-way over and across Little Turkey Creek Road, as <br />legally described in ROW B, for ingress and egress to and from Bauers Ranch. The Agreement <br />expressly reserves to the owners of Hitch Rack Ranch the following rights, as pertinent to this <br />
