COLORADO
Division of Reclamation,
Mining and Safety
Department of Natural Resources
1313 Sherman Street, Room 215
Denver, CO 80203
July 19, 2016
Andre LaRoche
Transit Mix Concrete Company
444 East Costilla Street
Colorado Springs, CO 80903
RE: Recommendation for Extension of the Review Period,
Hitch Rack Ranch Quarry, File No. M-2016-010
Dear Mr. LaRoche:
On August 5, 2016, the review period for the above referenced application will close and the Office shall
render its recommendation on the application. On August 24-25, 2016, the Board will consider the Office's
recommendation, the permit application and the objections, and will decide to approve, approve with
conditions, or deny the application.
The review process for complex applications with public objections, similar to the Hitch Rack Ranch
Quarry, routinely includes numerous exchanges of adequacy issues between the Office and Applicant, as
necessary for the Applicant to demonstrate the adequacy of the application. If there remain unresolved
adequacy issues at the close of the review period the Office is mandated to render a less than favorable
recommendation on the application, pursuant to section 34-32.5-115(4) C.R.S.
The deadlines by which the Office renders a recommendation and the Board makes a decision are set by
Rule 1.4.9. These deadlines may be extended by request from the Applicant, pursuant to Rule 1.4.1(10).
Therefore, the Applicant is encouraged to request an extension to the review period whereby the Board
hearing for consideration of the application, with objections, is extended from August 24-25, 2016, to
September 28-29, 2016. Upon receipt of an extension request from the Applicant, the Office shall
reschedule the Board hearing and determine the new dates for the Office's recommendation and Pre -
hearing Conference. The Office shall notice all parties and interested persons of the extended review
period and the rescheduled Pre -hearing Conference and Board hearing.
Sincerely, I
Wallace H.
