7/6/2016 <br /> To Whom It May Concern: <br /> Chevron U.S.A. Inc. owns and operates North Clear Creek Construction Materials Mine located within <br /> the Piceance Operations Area.From time to time Chevron uses the mine area to stockpile inert solids <br /> that accumulate from road and drainage maintenance activities.These inert solids meet the definition <br /> of inert solids as described in Rule 1.1 (20) below: <br /> "1.1(20)"Inert Material" means non-water-soluble and non-putrescible solids <br /> together with such minor amounts and types of other materials,unless such <br /> materials are acid or toxic producing,as will not significantly affect the inert <br /> nature of such solids.The term includes, but is not limited to,earth, sand, <br /> gravel, rock, concrete which has been in a hardened state for at least sixty <br /> days, masonry, asphalt paving fragments,and other inert solids." <br /> This imported inert material may accumulate in estimated volumes of 20 to 30 yards per year on <br /> average. This material will commonly be worked in as supplemental material with other quarried gravel <br /> material being removed and exported as road base and is not expected to accumulate to any significant <br /> quantities over the life of the mine. In some cases, if the material is suitable for top soil it may be set <br /> apart with top soil stock pile to be placed in future mine reclamation. Placement of such inert imported <br /> product will be done in accordance with proper backfill placement procedures as required during <br /> reclamation. <br /> e <br /> Vince Guinta, Production Supervisor -Chevron Piceance Operations <br />
