MEMORANDUM OF EASEMENT AGREEMENT <br />This Memorandum of Easement Agreement is agreed to by and between Centa Land Ca•. LLC, hereinafter referred <br />to as "Grantor", whose address is 44400 Olson Rd. Avondale, CO 81022 and Fremont Paving & Red Mix, <br />Inc., a Colorado Corporation, hereinafter referred to as "Grantee", whose address is 839 MacKenzie, <br />Canon City, CO 81212. <br />1. By a certain Easement Agreement dated August 6, 2010, as amended, hereinafter referred to as the <br />"Easement Agreement" between Grantor and Grantee, Grantee has acquired an easement across and <br />for the use of the following described property: <br />A tract of land 60 feet wide and 4590 feet long in Blocks 31, 41, 48 and 55 of the Frederica Mesa Subdivision, <br />Township 21 South, Range 62 West, in Pueblo County, Colorado beginning in the NE corner of Biock 31 <br />southward along the east boundary of Blocks 31, 41, 48 and 55 to the SE corner of Block 55; then westward along <br />the south boundary of Block 55 a distance of 60 feet; then northward perpendicular to the south boundary of Block <br />55 thru Blocks 55, 48, 41 and 31 to the north boundary of Block 31; then eastward along the north boundary of <br />Block 31 to the point of beginning, approximately 6.3 acres. <br />A tract of land 60 feet wide and 1142 feet long in Lot 2 of the SW4 of Section 17, Township 21 South, Range fit <br />West, in Pueblo County, Colorado beginning 1325 feet southwesterly from the NE comer of Lot 2 southward <br />approximately 1142 feet; then westward along the south boundary of Lot 2 a distance of 60 feet; then northward <br />approximately 1142 feet to the north boundary of Lot 2; then northeastward along the north boundary of Lot 2 to <br />the point of beginning, approximately 1.6 acres. <br />2. As set forth in the Easement Agreement, the parties agree to record this Memorandum of Easement <br />Agreement together with a legal description of the actual easement and right of way acquired and to be <br />used by Grantee, which is attached hereto as Exhibit A, and as more fully set forth in the Easement <br />Agreement. <br />3. The term of the Easement Agreement is twenty (20) years commencing on �Q ` <br />2012. <br />4.
