MEMORANDUM OF EASEMENT AGREEMENT <br />This Memorandum of Easement Agreement is agreed to by and between Hennchs Land and Cattle, LLC, hereinafter <br />referred to as "Grantor", whose address is 49707 E. U5 Highway 50, Avondale, CO 81022 and Fremont <br />Paving & Redi Mix, Inc., a Colorado Corporation, hereinafter referred to as "Grantee", whose address is <br />839 MacKenzie, Canon City, CO 81212. <br />I. By a certain Easement Agreement dated August 2, 2010, as amended, hereinafter referred to as the <br />"Easement Agreement" between Grantor and Grantee, Grantee has acquired an easement across and <br />for the use of the following described property: <br />The East ''/z of the SE '/a, Township 21 South, Range 63 West, all of which is located in Pueblo County, <br />Co. <br />2. Asset forth in the Easement Agreement, the parties agree to record this Memorandum of Easement <br />Agreement together with a legal description of the actual easement and right of way acquired and to be <br />used by Grantee, which is attached hereto as Exhibit A, and as more fully set forth in the Easement <br />Agreement. <br />The term of the Easement Agreement is twenty (20) years commencing on j a ` 4`-1 <br />2012. <br />4.
