II. H dy rolo�ic Balance <br /> A. Water Quality Standards and Effluent Limitations <br /> 1. The Division proposes to grant four small area exemptions from use of sediment <br /> ponds due to the limited size of the area and due to the fact that ponds and <br /> treatment facilities are not necessary for the drainage to meet the effluent <br /> limitations of Rule 4.05.2 and applicable State and Federal water quality <br /> standards for receiving streams and also due to the fact that no mixing of surface <br /> drainage with a discharge from underground workings will occur. Three of the <br /> small areas to be exempted are shown on Map 2.05.3-12 and are located on the <br /> westernmost portion of the permit area where the terrain is undulating and these <br /> areas cannot be made to drain to any sediment pond. The areas are 2.1 acres, 2.6 <br /> acres and 0.9 acres, respectively. The last area is located at the topsoil pile at <br /> pond 007, (4.05.2(3)(b)(i)). <br /> B. Sedimentation Ponds <br /> 1. Alternative design criteria and specifications have been approved for use in <br /> sediment pond design and/or construction. This decision is based on a thorough <br /> analytical demonstration by a qualified professional engineer that the resulting <br /> sediment pond will be as environmentally sound and structurally stable taking <br /> into consideration physical, climatological, other characteristics of the site, and <br /> will conform to the impoundment performance factor of safety of 1.3. <br /> (4.05.6(11)). <br /> C. Acid-forming and Toxic-forming Spoil <br /> 1. The Division proposes to approve temporary storage of acid- and toxic-forming <br /> spoil for more than 30 days. This decision is based on a finding that burial or <br /> treatment of these materials within 30 days is not feasible and the delay will not <br /> result in any material risk of water pollution or other environmental damage <br /> (4.05.8(3)). See Section 2.04.6 for identification, mining plan contingencies, and <br /> spoillmine soil reconstruction plans (respectively) that address acid or toxic spoil <br /> horizons. <br /> D. Ground and Surface Water Monitoring <br /> 1. The applicant will conduct monitoring of ground water in a manner approved by <br /> the Division (4.05.13(1)). The ground water monitoring plan is as follows: <br /> a. WFC maintained and operated a ground water monitoring network at the New <br /> Horizon I & 2 mining areas that consisted of 35 monitor wells. Each monitor <br /> well was measured for static water level on a monthly basis. Some of these <br /> wells are still being monitored under the currently approved hydrological <br /> 19 <br />
