Ritchey's Redi-Mix Concrete, Inc. shall CEASE AND DESIST any activities <br /> outside its prmit boundary, with the exception of activities ap rov d by the <br /> Division, in rit ng, necessary to comply with the conditions of this Order, prevent <br /> damage to the of site areas <br /> or protect health and safety, until Operator has timely <br /> completed the corrective actions set forth herein. <br /> The Board imposes against. the Operator the following CORRECTIVE <br /> ACTION: Operator shall, within 90 days of the mailing date of this Order, with all <br /> material in an approvable form within 180 days of the mailing date of this Order, <br /> submit a conversion application to increase the size of the current 110c reclamation <br /> permit to include the affected lands outside of the approved permit boundary, <br /> The Board imposes a CIVIL PENALTY for 54 days of violation at $1,000 per <br /> day for a total civil penalty of$54,000. All but $1,000 of the civil penalty- is <br /> suspended if the Operator complies with the corrective action within the time <br /> specified. The portion of the civil penalty not suspended - $1,000 - shall be due and <br /> payable within 30 days of the effective date of this Order. Failure to timely <br /> complete the corrective action set forth above shall result in the suspended civil <br /> penalty - $53,000 - becoming due and payable in full.
