BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> Violation No. MV-2016-036 <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF A POSSIBLE VIOLATION BY RITCHEY'S REDI-MIX <br /> CONCRETE, INC., CEASE AND DESIST ORDER, CORRECTIVE ACTIONS, AND <br /> CIVIL PENALTIES FOR FAILURE TO OBTAIN A RECLAMATION PERMIT <br /> PRIOR TO ENGAGING IN A NEW OPERATION, File No. M-2005-070 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> June 22, 2016, in Denver, Colorado as a consent agenda matter to consider possible <br /> violations by Ritchey's Redi-Mic Concrete, Inc. ("Operator"), cease and desist order, <br /> corrective action, and civil penalties for failing to obtain a reclamation permit from <br /> the Board or the Division of Reclamation, Mining and Safety ("Division") prior to <br /> engaging in a new operation, file number M-2005-070. <br /> The Board, being fully informed of the facts in the matter, hereby enters <br /> the following: <br /> FINDINGS OF FACT <br /> 1. The Operator holds a 110c permit for a 9.9-acre sand and gravel <br /> operation located in Section 26, Township 7 North, Range 47 West, 6th Principal <br /> Meridian in Phillips County, Colorado, permit number M-2005-070. The site is <br /> known as the Kreshmeyer Pit. <br /> 2. On April 20, 2016, the Division conducted a routine monitoring <br /> inspection. Jerry Ritchey was present at the inspection on behalf of the Operator. <br /> 3. During the inspection, the Division observed that the west end of the <br /> operation mined material from within Sandy Creek. At the east end, the operation <br /> has advanced through the northern creek bank and outside of the approved permit <br /> boundary. <br /> 4. Following the inspection, the Division, using aerial imaging and the <br /> Mining Plan Map, found that Operator has disturbed approximately 7.2 acres of <br /> land outside of the approved permit boundary. <br /> 5. The Division mailed Operator the April 20, 2016 inspection report on April <br /> 29, 2016. <br /> 6. The Division holds a financial warranty for the site in the amount of <br /> $7.400.00. <br />
