PERMIT#:M-2001-052 <br /> INSPECTOR'S INITIALS: ERR <br /> INSPECTION DATE: May 12,2014 <br /> OBSERVATIONS <br /> The inspection was conducted by Elliott Russell of the Division of Reclamation, Mining and Safety(Division). <br /> Jim McCormick of McCormick Excavation &Paving, LLC accompanied the Division on the inspection. The <br /> McCormick Pit is located approximately 18 miles south of Stratton, Colorado. This inspection was carried out <br /> as a part of the Division's routine monitoring inspection program. <br /> The site is an active 112c operation with 94 acres permitted and the post-mining land use is general agriculture. <br /> It was stated in the approved reclamation plan that 6-8 inches of topsoil and 10 inches of overburden would be <br /> strip and stockpiled, then returned to the pit for reclamation when mining was complete. The approved slopes <br /> for reclamation is 4H:1 V or flatter. The Applicant also committed to a phased reclamation plan with creating no <br /> more than 30 acres at any given time. After reviewing a 2013 NAIP aerial image, the site appears at or near this <br /> maximum allowed disturbance. The Applicant will either need to: <br /> 1. Complete reclamation on a portion of the mine and submit an acreage reduction release request prior to <br /> advancing the mine and creating more disturbance, or <br /> 2. Submit a Technical Revision to revise the number of acres in the phased reclamation approach. <br /> Please note that if the latter is chosen, the reclamation cost estimate is likely to increase with the addition of <br /> more acres. <br /> At 14:30, the Division met Mr. McCormick at the mine site located along County Road 32. At the time of the <br /> inspection it was windy and overcast, and the ground was dry with some areas being damp form a recent <br /> snowstorm. The mine site identification sign was observed at the entrance, but the sign had an incorrect permit <br /> number listed; please see the corrective action section of this report for more information on this problem. The <br /> boundary corners were delineated by t-posts and tires. <br /> There were no mining activities occurring at the time of the inspection and no equipment was on site. A large <br /> vegetated stockpile was located along the southern boundary which appeared to be topsoil and overburden. <br /> There was another stockpile just north of the pit which consisted of screened waste material. The pit was <br /> approximately 30 feet deep and the active dig was in the northeast corner. The Applicant had started to backfill <br /> the slopes along the south and west portions of the pit. <br /> Mr. McCormick had informed the Division that the company of the permit had underwent a legal name change <br /> in 2010 from Grasser Construction &Paving, LLC to McCormick Excavation& Paving, LLC. Under the <br /> requirements of Rule 1.12 the Applicant is required to submit a Request for Transfer of Mineral Permit and <br /> Succession of Operators Application Packet. Please see the corrective action section of this report for more <br /> information. The Division will also require the same process to be completed for the company's other active <br /> permit,the Stewart Pit II (M-2009-010). <br /> Photographs taken during the inspection are attached. <br /> Page 2 of 4 <br />
