COMMENTS: The applicant has requested a partial acreage release for 117.90 acres at the Green/Croissant Pit
(WDID 0403010), leaving 93.80 acres within the permit boundary. This request withdraws and replaces the
previous partial acreage release request dated January 13, 2016 (AR01). The Green/Croissant Pit is included in
the Loveland Ready Mix Concrete, Inc. plan for augmentation decreed in Division 1 Water Court case no.
2009CW105.
According to the Applicant, the subject 117.90 acres to be released are land that has not been mined or has
already been reclaimed in accordance with their permit requirements for wetlands mitigation. A total of 6.60
acres of jurisdictional and non -jurisdictional wetlands were required to be mitigated. The total amount of
wetlands actually mitigated is 8.08 acres, which exceeds the amount required by Army Corps of Engineer
Permit No. 200180205 by 1.48 acres. The Applicant has indicated that all exposed water surfaces are
augmented under case no. 2009CW105; however, wetlands also consume water through the consumptive use of
vegetation. The Applicant should verify that any wetlands created that exceed a one-to-one ratio to the
amount of wetlands disturbed by the mining operation to date are being accounted for and completely
augmented under the plan for augmentation decreed in case no. 2009CW105.
Subject to the above verification, this office has no objection to the requested partial acreage release being
granted for the Green/Croissant Pit, so long as the augmentation plan is operated in accordance with its
decreed terms and conditions.
