Permit M1990-057 4 <br /> Leadville Mill, Union Milling Company, LLC <br /> June 17,2016 <br /> MW-1 is a shallow well reaching only a perched aquifer. This well continues to contain <br /> insufficient water level for collecting and testing water. <br /> 2. Surface water Quality Sampling_ Quarterly surface water quality sampling from three <br /> stations, SW-1 through SW-3 could not be performed due to insufficient stream flows to <br /> collect samples during the summer, fall, winter and spring sampling periods. <br /> 3. TSF Construction. Delays associated with the final construction and operation of the <br /> mill continue to be influenced by poor metals market conditions. Meetings with potential <br /> investors were not successful in 2015 and we were not able to secure financing. We <br /> continue to meet with interested parties and while hopeful that we will receive funding to <br /> complete the project, it is not likely that this will happen to support construction activities <br /> for the 2016 building season. <br /> 4. Si na e. Permanent mill permit identification signs (metal-style) were maintained on <br /> the main gate to the facility and on the mill building, identifying the UMC and our permit <br /> number. <br /> 5. Fencing. The barbed wire property boundary fence was repaired in various areas <br /> where it was broken by wildlife. Fence maintenance is required by our Lake County <br /> Conditional Use Permit. <br /> 6. Permit Boundary. Permit boundary stakes were maintained as required. <br /> 7. Mill Facility Activity. The mill buildings and equipment were maintained in preparation <br /> of reconditioning and restarting the mill. <br /> 8. Sediment Control. Sediment control measures were performed on an as needed basis <br /> (temporary silt fence construction around the ore stockpiles, temporary historic tailings <br /> storage, and new tailings storage facility). Additionally, culverts were cleaned, and <br /> berms and roads were maintained as required. <br /> 9. Ore Stockpiles. Ore stockpiles remain covered with visqueen material as a temporary <br /> measure to minimize acid generating potential of sulfidic ores. This visqueen material <br /> remains in place as long as the material remains in place. Repairs were made as <br /> necessary on visqueen covers in October 2015. <br /> 10. Weed Control. Weed control measures were performed as required and according to <br /> the weed management plan. Identified weed species are Oxeye daisies and Canada <br /> thistle. Weeds occur sporadically near access roads, the mill building and the fence <br /> bordering the water treatment plant (East side of property). Over the last 5 years, <br /> weeds have been significantly eliminated. Current practice involves walking around <br /> property and spraying weeds as required over the June—September growing season. <br /> 11. Permitting Activity. The following permitting activities were performed during the year. <br /> • UMC submitted a status report to the Lake County Commissioners as required <br /> by our Conditional Use Permit (CUP). <br /> • UMC, in a public meeting held on December 21, 2015, revised certain <br /> requirements in its CUP. The CUP has, with unanimous agreement by the <br /> County Commissioners, made the following amendments to the CUP <br /> o Permanent water must be obtained within 3-years after the <br /> commencement of operations; <br /> o The firewater tank must be installed and operational prior to <br /> commencement of operations. <br /> o The condition requiring a non-terminable easement for access was <br /> changed to a requirement that the permit holder must be able to <br /> demonstrate on an annual basis if requested that he or she has the <br /> legal and physical access to the site. <br />
