Exhibit A—Legal Description <br /> DRMS M2001-022 6/14/16 <br /> Thence along said East right-of-way line N24°42'31"E, 1610.78 feet to a point on the South line of a <br /> certain parcel described in deed, recorded in Book 882 under Reception No. 1804393, records of said <br /> County;thence along the South and east lines of said parcel of land N89°57'30"E,80.04 feet;thence <br /> N00°26'00"E,80.06 feet to a point on the South line of State Highway 402;thence along said South line <br /> N89°58'56"E,2432.60 feet to the True Point of Beginning. The above described parcel of land contains <br /> 142.82 acres, more or less and is subject to all easements,agreements and rights-of-way of record. <br /> In preparation of this release request,a new boundary survey was prepared by Souder Miller& <br /> Associates in December,2015. At this time it was decided to adjust the permit boundary line to reflect a <br /> 50 foot reservation from Weld County Recorded Exemption 0957-30-2-RE 134, Book 714,dated April 4, <br /> 1974,that"no structure of a permanent nature shall be constructed within 50 feet of the centerline of <br /> county road. This 20 feet being reserved for future ROW". Therefore, as part of this release the permit <br /> boundary line has been moved to 50 feet from centerline of WCR 13 and CR 54. <br /> The revised Mining Plan Exhibits and revised Reclamation Plan Exhibits show the following areas will be <br /> removed from the mining boundary in this partial release: 99.8 acres will be released from the LRM <br /> property,and 16.3 acres will be released from the CFF property. (rounded to the nearest 1/10th of an <br /> acre for simplification) <br /> The area remaining within the revised mining boundary is as follows: <br /> LRM: 48 acres+/- <br /> CFF: 44.9 acres+/- <br /> Total remaining area within revised mining permit boundary=48+44.9=92.9+/0.5acres <br /> Total area removed from mining permit boundary=209—92.9= 116.1+/0.5 acres <br /> FIGURES 1 thru 4 are included to illustrate assumed areas for original permit area and remaining permit <br /> area. <br /> Page 4 of 5 <br />
