This is to further clarify <br /> the existing permit boundary area,the release area,and the remaining area within <br /> the permit boundary. <br /> The original permit area of 210 acres,was not clearly defined in the application. The <br /> intent of this release is to clarify what is remaining inside the permit boundary after <br /> this partial release, not to debate the original permit area calculations. Therefore, <br /> for purposes of this partial release,the original permit area has been determined <br /> from the following assumptions: <br /> The original permit boundary lines along CR 54 and WCR 13 are 40 foot from <br /> the centerline of the road. The revised permit boundary lines along CR 54 and WCR <br /> 13 are 50 foot from the centerline of the road. This reflects a 50 foot reservation <br /> recorded in the attached Weld County Recorded Exemption;this reservation was <br /> used in the most recent Alta Survey. <br /> The additional 10 foot width to be released along CR 54 and WCR 13 is on <br /> LRM property,and has not been mined. Actual Weld County deeded ROW is 30 foot <br /> from centerline of road. <br /> The 110 foot setback from the Big Thompson River is shown outside the <br /> original permit boundary line. However,this setback area is included in the 64.093 <br /> acres of the original Landmark ALTA Survey area of Croissant Family Farms. Because <br /> this area was originally shown outside the original permit boundary line,2.68 acres <br /> has been removed for the 110'setback from the riverbank as shown on the original <br /> permit drawings. <br /> Using these assumptions,the original permit area adds up to 208.98 acres. This <br /> release request then adds up to a total of 116.1 acres,leaving a total of 92.9 acres <br />
