(b) Specifications of drill holes and casings proposed to be used: <br />• (c) A plan for trcannent, confinement or disposal of all acid-forming, <br />toxic -forming or radioactive gases, solids, or liquids constituting a fire health safety or environmental hazard <br />caused by the mining and recovery process; and <br />• <br />(d) Plans for monitoring surface and ground water and air quality, as required <br />by the Division. <br />(3) No permit shall be issued for operations covered by 2.06.11, unless the Division or <br />Board first finds, in writing, upon the basis of a complete application made in accordance with 2.06.1 I(2), that the <br />operation will be conducted in compliance with all requirements of these Rules relating to underground mining <br />activities and 4.29. <br />RESPONSE <br />The mining proposed within this permit area is underground mining and no surface coal mining is intended to be <br />conducted utilizing in situ processing. Therefore, the requirements of this rule are not applicable to the permit <br />revision application. <br />Rule 2.06.12 - Surface Coal Mining and Reclamation Operation Requirements Involving the Removal of <br />Coal from Coal Refuse Piles <br />(1) Scope. The provisions of 2.06.12 shall apply to anv person engaged in surface coal mining and <br />reclamation operations who removes or intends to remove more than 250 tons of coal from coal refuse piles within <br />12 consecutive calendar months in any one location. No person shall engage in operations subiect to 2.06.12 except <br />under a permit or approval of a revision to an existing permit issued by the Division in accordance with the <br />requirements of 2.06.12. <br />2) ADDlication contents. Each application for a permit or approval of a revision to an existing <br />permit subiect to the requirements of 2.06.12 shall contain that information required by 2.03, 2.04, 2.05, and 2.06 <br />which is necessary for the Division to make a written deterrination of compliance with all requirements of the Act <br />and these Rules in accordance with 2.07.6. The infonnation necessary to satisfy this requirement shall be <br />determined in consultation with the Division and consideration shall be given to the specific conditions of the site <br />and scope of the proposed operation <br />RESPONSE <br />The mining proposed within this permit area is underground mining.
