• <br />Vo,, z <br />Rule 2.06.1 - Scope <br />Doc, <br />D '2�"�°� III !IIlIIIIIlIIIIII <br />999 <br />Rule 2.06 establishes minimum requirements for permits for the followine special cateeories of surface <br />coal mining and reclamation operations. which are in addition to all applicable permit application requirements and <br />procedures of Rule 2: <br />(1) Experimental practices mining; <br />(2) Mountaintop removal mining: <br />(3) Steep slope mining <br />(4) Variances from approximate original contour restoration requirements for sleep slope mining. <br />5) Prime farmlands <br />(6) Variances for delay in contemporaneous reclamation requirement in combined surface and <br />underground mining operations: <br />and <br />(7) Minineofalluvial valley floors, <br />(S) Auguring; <br />(9) Coal processing plants or support facilities not located within the permit area of a specified mine; <br />(10) In situ processing activities. <br />Rule 2.06.2 - Experimental Practices Mining <br />(1) Scope. The provisions of 2.06.2 apply to any person who conducts or intends to conduct surface <br />coal mining and reclamation operations under a permit authorizing the use of alternative mining practices on an <br />experimental basis if the practices require a variance from the environmental protection performance standards of <br />Rule 4. <br />2) The ouroose of 2.06.2 is to provide requirements for the permitting of surface coal minine and <br />reclamation operations that encourage advances in mining and reclamation practices or allow postmining land use <br />for industrial, commercial, residential or public use (includine recreational facilities) on an experimental basis. It <br />docs not include small test plots of limited planned duration that affect a small percent of the total area being <br />minine or reclaimed and that do not result in violations of any applicable air or wafer environmental reeulations. <br />(3) Fxperinmental practice means the use of alternative surface coal mining and reclamation operation <br />practices for experimental or research purposes. <br />4) No person shall cneaee in or maintain anv experimental practice, unless that nracticc is first <br />approved by the Board, upon the recommendation of the Division. and with the approval of the Director of the <br />Office of Surface Mining as an authorized representative of the secretary of the United States Department of <br />• Interior. The Director must concur in the approval of am experimental practice and the approval of any revision, <br />which proposes significant alterations in the experimental practice before the experimental practice, is authorized. <br />Permit Renewal No. 3 2.06-1 3/5/99 <br />
