Act" and Section 502 of the "Surface Mining Control and Reclamation Act" of 1977 P.L. 95-87), as determined <br />by the Division, the Board or Division shall unless such application is withdrawn act on such application in <br />accordance with the `Colorado Mined Land Reclamation Act" and Section 502 of the "Surface Mining Control <br />and Reclamation Act' of 1977 (P.L 95 -87); except that in no event shall such person be relieved of the obligation <br />to obtain a permit as required by Section 34 -33- 101(1) of the Act 2 01 3(1) and P L 95-87. <br />(4) Except as provided for in 2 01 3(2) and 2.01.3(5), no person conducting or intending to conduct <br />surface coal mining and reclamation operations shall be relieved of the obligation to obtain a permit as required by <br />2.01.3(1) and the "Surface Mining Control and Reclamation Act' of 1977 (P .L. 95-87). <br />(5) The operator of any surface coal mining and reclamation operation on Federal land whose permit <br />application and mining and reclamation plan have been approved by the Board or Division and the Federal Office <br />of Surface Mining under any permanent Federal regulatory pro ram prior to the approval of the Colorado <br />regulatory program by the Secretary, shall be considered to have satisfied the permit requirements of this Rule and <br />need not submit_ another application for a permit or permit revision within the two months following the initial <br />approval of the Colorado regulatory program provided however, that: <br />(a) Proposed revisions and modifications of said permit must be submitted within twelve <br />months of the approval by the Secretary of the Colorado regulatory program <br />(b) Revisions or modifications of said permit are made to reflect substantive differences <br />between the Colorado regulatory program and the Federal regulatory program and <br />(c) All requirements of the Act and 2.07, pertaining to public participation and notification <br />are complied with. <br />(6) No permit shall be required for reclamation operations on abandoned or unreclaimed lands not <br />required to be reclaimed under state or Federal law. <br />RESPONSE <br />TCC is hereby submitting a complete permit revision application pursuant to this rule and Rule 2.08.4. <br />This application revises previously approved Permit No. C- 056 -82 and is designed to comply with the <br />applicable provisions of Rules 2 and 4. <br />Since some of the coal mining and reclamation operations proposed herein will take place in part in <br />Federal coal and /or land, TCC will submit this permit revision application in a manner to satisfy the <br />requirements of the "Surface Mining Control and Reclamation Act' of 1977 (P.L. 95 -87) and other <br />applicable Federal laws, as well as applicable laws of the State of Colorado. <br />RULE 2.01.4 - PERMIT REQUIREMENTS FOR NEW SURFACE COAL MINING AND <br />RECLAMATION OPERATIONS <br />Each person who expects to conduct new surface coal mining and reclamation operations within the eight <br />month period following approval of the Colorado regulatory program shall file a complete application for apermit <br />in accordance with applicable provisions of Rules 2 and 4 <br />RESPONSE <br />This permit revision application is being filed in accordance with Rule 2.01.3 above. <br />MR 97 -154 2.01 -2 Revised 10/01/97 <br />
