Finding of No Significant Impact (FONSI), describes the impacts that may result from <br />approval of this mining plan modification and its alternatives. The FONSI and <br />supporting environmental analyses are included in this decision document. <br />OSM's review of the proposed action did not identify any issues that required resolution <br />via the addition of special conditions to the mining plan modification approval. <br />Publication of four consecutive weekly newspaper notices in the Durango Herald notified <br />the public of the availability of the administratively complete PAP for review. The last <br />publication date was September 7, 2006. <br />OSM has determined that a bond for $10,200.00 is adequate for the Federal Indian lands <br />permit associated with this mining plan. The bond is payable to the United States of <br />America. <br />A chronology of events related to the processing of the PAP and this mining plan decision <br />is included with the decision document. The information in the PAP, and other <br />information identified in the decision document, has been reviewed by OSM. <br />OSM's administrative record of this new mining plan consists of the following: <br />- the PAP submitted by National King Coal, LLC. and updated through <br />November 29, 2006; <br />- OSM's Technical Analysis and Findings for Federal Indian lands permit <br />CO -0106A pursuant to the Surface Mining Control and Reclamation Act of <br />1977 (SMCRA), 30 U.S.C. §§ 1201-1328; <br />- Environmental Assessment, EA Number CO-SJFO-00-102EA, National King <br />Coal, LLC, Coal Lease Application, East Alkali Tract, COC -62920; <br />- the FONSI of the proposed action and alternatives prepared by OSM; <br />- other documents prepared by OSM, and; <br />- correspondence developed during the review of the PAP. <br />Attachments <br />
