Page 2 <br />June 9, 2016 <br />regarding property ownership or legal boundaries, nor should the Division's actions be inferred to create private <br />property rights should property ownership be adjudicated in district court. <br />Coal Rule 2.10.3(1)(a) requires operators to include a map in the application that shows the "boundaries of land <br />and names of present owners of record of those lands, both surface and subsurface, included in or contiguous to <br />the permit area." In addition, Coal Rule 2.03.3(1) requires permit application information to be current.
