Below is a <br />discussion of the Division's review. Bolded items are issues that the Division requests Twentymile Coal, <br />LLC. (TC) respond to. <br />Rule 2.04.13 <br />(1) The report was received by the Division on February 12, 2016 via e-mail prior to the February 15, <br />2016 deadline. Also, a hard copy of the report was received by the Division on February 18, <br />2016. <br />a. The name and address of the permittee and permit number is listed on the cover letter of <br />the ARR and the ARR form submitted. <br />b. The cover letter indicates that TC was granted approval to disturb an additional 14.8 <br />acres in 2015. Also, the 2015 ARR form submitted by TC indicates that 14.8 acres were <br />permitted to be disturbed in 2015 bringing the total disturbed area acreage to 726.4 acres. <br />It appears that TC modified this form to list the "permitted" acres to be disturbed. <br />However, the intent of this item on the form and what is required by Rule 2.04.13(b) is to <br />document the number of acres that were actually disturbed within a calendar year and <br />cumulatively over time. <br />Please evaluate the number of acres actually disturbed at the Foidel Creek Mine. A <br />similar issue was cited during the review of the 2014 annual reclamation report. <br />For the 2016 annual reclamation report, please cite the actual disturbed acres at the <br />Foidel Creek Mine on the Annual Reclamation Report Form. <br />c. The report indicates that no backfilling and grading activities were conducted in 2015. <br />d.
