<br />Dear Mr. Hernandez:
<br />Our office represents Snowcap Coal Company, Inc. ("Snowcap"), the permittee under
<br />DRMS Permit No. C-1981-041 (the "Permit"), as modified by an Order dated October 28,
<br />2015 ("October Order"). It is Snowcap's understanding that James Beckwith, counsel for
<br />Mr. Rudolph Fontanari, Jr., and Rudolph Fontanari, Jr. and Ethel Carol Fontanari, as trustees
<br />of the Rudolph and Ethel Fontanari Revocable Living Trust (together "Fontanari"), have
<br />requested a meeting with the Division of Reclamation, Mining & Safety ("DRMS")
<br />concerning Snowcap's compliance with the October Order.
<br />We are aware that in a May 6, 2016 letter to DRMS, Mr. Beckwith, on behalf of
<br />Fontanari, has alleged certain deficiencies with Snowcap's compliance with the October
<br />Order. We are also aware that counsel for Jason Carey and Powder Mountain Properties,
<br />LLC, (together "Carey") has joined in those comments. If DRMS determines that it is
<br />inclined to take a meeting with Fontanari and/or Carey, and their respective legal counsel.
<br />Snowcap requests the right to have its own representatives and legal counsel present at such
<br />a meeting or meetings. This would be for the purpose of both understanding further the
<br />deficiencies alleged by Fontanari and/or Carey, and to provide additional or responsive
<br />information if so requested by DRMS.
<br />Further, we request that Snowcap be copied on all further communication by DRMS
<br />to representatives of Mr. Fontanari and Mr. Carey concerning the Permit, the October Order,
<br />and Snowcap's compliance with either.
