MEMORANDUM OF EASEMENT AGREEMENT <br /> This Memorandum of Easement Agreement is agreed to by and between Henrichs Land and Cattle, LLC, hereinafter <br /> referred to as"Grantor",whose address is 49707 E. US Highway 50, Avondale, CO 81022 and Fremont <br /> Paving& Redi Mix, Inc., a Colorado Corporation, hereinafter referred to as "Grantee",whose address is <br /> 839 MacKenzie, Canon City, CO 81212. <br /> 1. By a certain Easement Agreement dated August 2, 2010, as amended, hereinafter referred to as the <br /> "Easement Agreement"between Grantor and Grantee, Grantee has acquired an easement across and <br /> for the use of the following described property: <br /> The East 1/2 of the SE 1/4, Township 21 South, Range 63 West, all of which is located in Pueblo County, <br /> CO. <br /> 2. As set forth in the Easement Agreement,the parties agree to record this Memorandum of Easement <br /> Agreement together with a legal description of the actual easement and right of way acquired and to be <br /> used by Grantee, which is attached hereto as Exhibit A,and as more fully set forth in the Easement <br /> Agreement. <br /> 3. The term of the Easement Agreement is twenty(20)years commencing on I 6 ' if--t <br /> 2012. <br /> 4.
