PERMIT#: M-1986-140 <br /> INSPECTOR'S INITIALS: MAC <br /> INSPECTION DATE: May 31,2016 <br /> OBSERVATIONS <br /> The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br /> (Division). Tammie Crawford of Park County was also present for the inspection. The Wright Pit is located <br /> approximately 12 miles northeast of Fairplay and about 3/4 mile north of Highway 285. The site is permitted <br /> for 9.64 acres and the post-mining land use is rangeland. <br /> Gen. Compliance With Mine Plan: <br /> The site was being actively mined at the time of the inspection. The Operator has a contract with A& S <br /> Construction to perform mining. The aggregate material is being crushed and screened within the pit. The <br /> mining operation is advancing to the north. Topsoil has been stripped and stockpiled along the perimeter of <br /> the pit. The Division discussed relocating the topsoil stockpile along the northern edge of the pit, since mining <br /> will eventually advance through the current location of the stockpile. In addition, if the topsoil is not replaced <br /> within a single growing season, then it will need to be stabilized with a vegetative cover as required by <br /> Construction Materials Rule 3.1.9(1). The Division also observed numerous product stockpiles outside of and <br /> to the north of the pit. <br /> Signs and Markers: <br /> The permit sign was posted at the site entrance as required by Rule 3.1.12. However, the Division was unable <br /> to locate all of the boundary markers. Specifically, the northwest and northeast boundary markers could not <br /> be located. Additional information regarding the boundary markers may be found under the next section of <br /> the report. <br /> Off-site Damage: <br /> There are three areas of disturbance which are associated with the Wright Pit: the pit, the stockpile area north <br /> of the pit and disturbance associated with a former asphalt batch plant located east of the pit and north of the <br /> access road. During the last inspection conducted in 2011, the Division documented the presence of the <br /> asphalt batch plant. There were no boundary markers present at the time of the inspection and the Division <br /> was unable to determine whether the asphalt batch plant was within the approved permit boundary. A <br /> problem was cited and the Operator was required to replace the boundary markers and to provide the <br /> Division with a copy of a surveyed map of the permit boundary. A review of the permit file found the Operator <br /> did not comply with the corrective action. <br /> Following the inspection, the affected area was measured using a 2013 aerial image of the site and Google <br /> Earth Pro software. The Division found the Operator has affected approximately 23.26 acres, or 13.62 acres <br /> beyond the maximum allowed disturbance of 9.64 acres. The acreages associated with each of the disturbed <br /> areas are as follows: pit (12.35 acres), stockpile area (6.33 acres), former asphalt batch plant area (4.58 acres). <br /> As noted above, a 2013 aerial image was used to measure the disturbed area, so the current amount of <br /> disturbance may be greater than 23.26 acres. The Division was unable to determine which of the affected <br /> areas are outside of the permit boundary due to a lack of boundary markers. However, the Operator has <br /> exceeded the maximum allowable disturbance of 9.64 acres.
