BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> Violation No. MV-2016-031 <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF A POSSIBLE VIOLATION BY ARKINS PARK STONE <br /> CORPORATION, CEASE AND DESIST ORDER, CORRECTIVE ACTIONS, AND <br /> CIVIL PENALTIES FOR FAILURE TO OBTAIN A RECLAMATION PERMIT <br /> PRIOR TO ENGAGING IN A NEW OPERATION, File No. M-1985-212 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> May 25, 2016 in Denver, Colorado as a consent agenda matter to consider possible <br /> violations by Arkins Park Stone Corporation ("Operator"), cease and desist order, <br /> corrective action, and civil penalties for failing to obtain a reclamation permit from <br /> the Board or the Division of Reclamation, Mining and Safety ("Division") prior to <br /> engaging in a new operation, file number M-1985-212. <br /> The Board, being fully informed of the facts in the matter, hereby enters <br /> the following: <br /> FINDINGS OF FACT <br /> 1. The Operator holds a 112c permit for a 177-acre sandstone mining site <br /> located in Section 35, Township 6 North, Range 70 West, 6th Principal Meridian in <br /> Larimer County, Colorado, permit number M-1985-212. The site, known as Arkins <br /> Park Quarries, is located approximately 2.25 miles south of Masonville, Colorado. <br /> 2. On December 10, 2015, the Division conducted an inspection in accord <br /> with its normal monitoring program. Chantea Honer and Jordan Wicks were <br /> present at the inspection on behalf of the Operator. <br /> 3. During the inspection, the Division observed, among other things, that <br /> a storage area located outside of the permit boundary. Following the inspection, the <br /> Division, using aerial mapping and the Mining Plan Map, found that a portion of <br /> the western permit boundary is incorrectly delineated in the field. As a result, the <br /> Division found that approximately 16.3 acres of land have been affected outside of <br /> the approved permit boundary. On the inspection report, the Division noted that <br /> Operator affected land outside the permit boundary and directed Operator to <br /> conduct a professional survey of the permit boundary, as it is currently delineated, <br /> and provide the Division with a map depicting the surveyed permit boundary on or <br /> before February 8, 2016. <br />
