Public Notice

The Division of Reclamation, Mining and Safety, in accordance with Title 34, Article 33, of the Colorado
Revised Statutes, hereby issues notice that on June 7, 2016, a minor revision application (MR-298) to the
Foidel Creek Mine, Permit No. C-1982-056, operated by Twentymile Coal, LLC, 29515 Routt County
Road No. 27, Oak Creek, CO 80467 was considered complete for the purposes of filing. Twentymile
Coal, LLC. has submitted a minor revision to the permit to reflect the addition of a flocculant delivery
system and use of a flocculant at the Fish Creek Borehole and Water Treatment Installation to drop-out
coal fines and enhance water quality prior to discharge. The proposed change is limited to an additional
option for water treatment, specifically to address reduction of suspended coal fines prior to discharge and
does not replace or supersede existing approved treatment methods. This revision does not involve the
construction or installation of any additional structures or equipment (with the exception of a metering
pump). According to Twentymile Coal, LLC. the flocculant selected (Amerifloc 490) is approved for use
in drinking water systems and should have very limited potential for adverse impacts to aquatic life at low
dosing rates. The applicant is not proposing additional surface disturbance outside of the area currently
approved for disturbance. All reviews and comment periods as provided in the Act and Regulations
promulgated thereunder initiate from this date of filing.

Posted June 7, 2016

C-MR-03
