PERMIT#: M-2015-030
INSPECTOR'S INITIALS: ECS
INSPECTION DATE: May 27, 2016
OBSERVATIONS
This inspection report serves as documentation of possible unpermitted mining activity observed by Eric Scott
of DRMS on the morning of May 27, 2016. This activity was observed by DRMS on the northwest corner of
Weld County Road (WCR) 8 and Highway 85 -the location of the proposed Asphalt Specialties Chavers Mining
Resource site.
Approximately 25 acres at the south end of the proposed permit area has been stripped of topsoil, and a large
topsoil stockpile has been created on the west side of the currently disturbed area (please see attached map
and photos). Photos 1-4 were taken looking west from the east side of the site along the Hwy 85 right of way.
Photos 5 and 6 were taken from the south side of the site along WCR 8 looking north. As can be seen in
Photos 1 and 2, activity was on-going on the morning of May 27, 2016 with a large track-hoe loading topsoil
into multiple trucks for placement onto the topsoil stockpile.
A permit application has been submitted to DRMS for this location, however the permit has not yet been
approved and no reclamation bond has been posted for the disturbance at the site. The appropriate
reclamation bond must be posted and approved by DRMS before a reclamation permit can be issued and
mining may commence.
Therefore, as stated on the first page of this report, DRMS considers this observed activity to be a violation of
the Colorado Land Reclamation Act for the Extraction of Construction Materials. A "reason to believe a
violation exists" RTB letter will be sent to the operator to provide details for an upcoming Mined Land
Reclamation Board hearing via certified mail.
Inspection Contact Address
Rob Laird
Asphalt Specialties Co.,Inc.
10100 Dallas St.
Henderson,CO 80640
