Box 1319
Carbondale, CO 81623

RE: Grand River Park Project, Permit No. M-2006-046, Estimated Reclamation Cost Update
Dear Mr. Mello:

The Colorado Division of Reclamation, Mining and Safety (Division) received your letter dated May
25, 2016. This letter was in response to the Estimated Reclamation Cost Update letter that the
Division sent on March 31, 2016. Previous bond estimates were calculated based on reclaiming the
entire site. That included 53 acres requiring topsoil and seeding. Your response indicated that to
date only 57 acres have been affected, the majority of which will become lakes. Additionally not all
mining phase have been affected and therefore the current bond in place should be more than
enough to cover the actually liability. Based on your response it appears that you would like the
Division to incrementally asses surety increases based on the commencement of each mining phase.
In order for the Division to make these changes please submit this request in the form of a technical
revision with the $216 revision fee. Please make a commitment to notify the Division in the annual
report of any progress made in new mining phases. The self-report will include total acreage of the
phase, acres to be topsoiled and seeded, and volume of phase pond to be pumped down for dirt work.
This additional information will aid the Division in accurately updating the bond by phases. Through
this reporting surety will be incrementally assessed based on mining progress as needed.
If you require additional information, or have questions or concerns, please feel free to contact me.
Amy Yeldell at the Division of Reclamation, Mining and Safety, 1313 Sherman St., Room 215,
Denver, CO 80203.
